The Department of Homeland Security (DHS) identified the suspect as Miguel Francisco Mora Nunez, a Dominican national who was arrested by the Border Patrol in April 2023.
Nunez was released to the United States after being arrested on the Arizona border, although he still had an active deportation order.

Nunez then took a scooter and approached as people sitting near the water and chatted, according to police. The official has not yet determined.
The officer, who was not in uniform, took out a gun to protect himself, and a gunfight followed.
The agent was hit in the face and forearm and was transported to the hospital, where he is currently in a stable state. He is expected to survive.
Nunez was also injured in the gunfight and was shot dead in his legs and groin. Authorities said he got off at a hospital in the Bronx.
DHS also told Fox News that Nunez has an active arrest warrant Massachusetts, In addition to previous felony arrests.

In a press conference on Sunday, New York Mayor Eric Adams said Nunez was in custody.
