Jury Stalemate in Tornado Cash Trial, Judge Issues Allen Charges



After four days of deliberation, jurors at the Roman Storm trial told the court that they remained deadlocked on certain charges prompting the use of Allen’s allegations to encourage further discussion.

Alan’s allegations, sometimes referred to as “dynamite charges,” are a special order from a judge to a stalemate jury, urging them to re-examine their positions and attempt to reach a consensus verdict.

according to In a court report by Inner City Press on Wednesday, Brian Klein, the storm’s attorney, opposed the allegation, saying it was unlikely that the jury would make it clear that a unanimous ruling was urged instead to consider accepting a partial judgment.

Justice Katherine Polk Failla stood with prosecutors who would rather continue to deliberate than accept partial judgments, while U.S. assistant attorney Thane Arad said: “Let’s cross that bridge when we get there.”

The move kept the trial alive and delayed the potential trial, but also highlighted the deep divisions of the jury on key aspects of government cases.

The defense said Storm wrote open source code and had no control over how it was used, raising broader questions about the responsibilities of software developers in decentralized systems.

The case has great significance for crypto developers and the boundaries of responsibility for writing decentralized software. If convicted and subject to maximum penalties for various charges, the storm faces up to 45 years in prison.
