Karen Reading Retrial: First Jury Questions May Be Favored in Defense, Experts Say

The first group of jurors’ questions were sent back to the court Karen Read Experts say the retrial may be a positive sign of her defense – at least it has to do with the worst allegations she faces.

Judge Beverly Cannone read three questions in court about 11 a.m. Tuesday:

  1. “What is the schedule for OUI (operating under impact) charges? 12:45 or 5 AM?”
  2. “Is Karen’s interview evidence a video clip?”
  3. “Is there a guilty guilt, such as Crime 2 No. 5, convicted of the overall charge?”

“The defense lawyers are unquestionably happy,” said Jack Lu, retired Massachusetts judge and Boston College law professor.

Read’s first trial ended on a jury last year after jurors failed to reach a deal in less than 25 hours in four days.

Defense attorney David Yannetti warned that the existing verdict had “real potential to confuse the jury and cause errors” – focusing on 2 Earls – drunk driving manslaughter. The document shows that jurors can find that she has no crimes and a series of few crimes on the charges, or that they can find her guilty of three less cruel crimes, from involuntary murder to drunk driving.

Read had a drink at trial within a few hours before O’Keefe’s death.

“They poured my drink at McCarthy’s, which is where I eat most of the alcohol, the weakest vodka tonic,” she told the camera. “It tastes like all soda and lime, not that I need it to be a martini, but that there might be vodka in it.”

Read’s blood alcohol content was estimated at about 0.09% when he was hospitalized for a mental health check after discovering O’Keefe’s body. Nine hours ago, at the time of his death, it was estimated that the defense believed she could have continued drinking after she returned home.

“It tells me they’re focusing on how alcohol works in this situation, and it’s also important for the last jury,” said Massachusetts defense attorney Grace Edwards.
