Thomas is a biological male who has previously competed for the Upenn Men’s swimming team for 2017-20 years under the name Will Thomas. According to the lawsuit, Thomas is the female swimmer introduced by head women’s swimmer Mike Schnur as their incoming teammates at a team meeting in the fall 2019.
Each of the three plaintiffs claimed that the experience caused them to be “repeatedly emotionally traumatized.”
The plaintiff claimed that the university administrators accepted Thomas’ acceptance of Thomas in the team and in the locker room throughout the process. Former swimmers said they were led to their concerns about becoming Thomas teammates rooted in “psychological issues.”
“UPENN administrators told women that if anyone is working to accept Thomas’ participation in the Upenn Women’s Team, they should seek consultation and support from the CAPS and LBGTQ Center,” the lawsuit said.
“The administrator also invited women to a speech entitled ‘trans 101.’ So the women were told that Upenn’s position was that if one of the women on the team had any problems with trans men in her team, it was that the woman had psychological problems and needed consultation.”
The plaintiff also claimed that administrators warned them not to publicly object to the situation.
“Upenn administrators then tell women that if women speak publicly about their concerns about Thomas joining the women’s team, the reputation of those who complain about Thomas’s on the team will be tainted by trans fears for the rest of their lives and they may never find a job,” the lawsuit. ”
Three female swimmers claim they will be believed to be evacuated from the team if they try to protest Thomas’ participation ahead of the 2022 Ivy League championship.

The lawsuit says coaches and UPENN administrators told women swimmers not to talk about Thomas’ situation. Schnur allegedly told the women swimmer that Thomas would not share the locker room with them when requested after the initial introduction.
But it was said to have changed later.
Thomas officially begins practicing and competes with female swimmers in fall 2021.
At that time, female swimmers said they found it wrong to Schnur’s alleged claim that Thomas would not share the locker room.
“When Upenn’s female swimmers returned to school in the fall of 2021, they were shocked to find Thomas was allowed to use Upenn’s women’s locker room and allowed to use the women’s locker room during swimming competitions,” the lawsuit said.
“Kaczorowski only learned that Thomas was authorized to use the women’s locker room by Upenn, when Kaczorowski walked into the women’s locker room and found Thomas in front of the change of clothes.”

“Pennsylvania has been following – and continues to follow – the applicable policies of the IX and NCAA regarding transgender athletes. NCAA eligibility rules were changed in February 2025, with orders 14168 and 14201, and Pennsylvania will continue to comply with these new rules.
“Pennsylvania has never maintained its own policies for the participation of trans athletes in intercollegiate sports. We also do not uphold policies related to other NCAA rules. We abide by NCAA and IVY Alliance Rules to ensure fair and transparent sports competitions for all schools and participants.”
