Idaho law has a new challenge to keep transgender people From entering the women’s bathroom.
Idaho HB 264as a way to protect “women’s privacy” in bathrooms and dormitories, two transgender plaintiffs claimed that the law would allow them to harassment further.
Atlas Jones and Sophie Smith (pse name) say they have not had any problems using the restrooms of the gender they identified with at Boise State University and the University of Idaho, but now they are filing complaints against the law, which would fear that the law would cause “irreparable harm” and could be harassing them by their peers.

“Atlas is a man in his daily life and he received medical treatment to align his identity with his identity, including hormone therapy, which allowed his body to promote his body and deepen the sound of the voice,” the complaint explained. “Consistent with BSU’s long-term practices, allowing him to do so, Atlas has been using men’s bathroom throughout the process without any problems. In using men’s bathroom, Atlas has never encountered any criticism, harassment or any other problem with others.”
The complaint said that if Atlas was going to use a women’s bathroom, “he would be at risk of harassment and violence” because onlookers would think the man was using a women’s bathroom.
“Using a restroom that doesn’t match gender identity will put the plaintiff at risk of being considered transgender,” the claim notes. “Atlas and Sophie are not transgender to most people on campus because they don’t want to face inequality treatment, and because it’s usually irrelevant.”
Other concerns outlined in the complaint include the use of single bathrooms and the limited stigma surrounding them, and the “avoidance of fully using the restroom on campus” that could harm one’s own health.
